Toyota has agreed to a proposed $299.5 million settlement to resolve allegations that Toyota Industries Corporation, Toyota Material Handling,Inc., and Toyota Material Handling, N.A. engaged in improper conduct related to emissions certification for certain Toyota internal combustionengine forklifts sold in the United States. Plaintiffs allege that class members paid for forklifts and related ownership or lease costs affected by thisconduct. Defendants deny wrongdoing, and the settlement remains subject to final Court approval.

Who will be eligible?

You may be eligible to participate if your organization purchased or leased a covered Toyota internal combustion forklift built between 2007 and 2021 and sold in the United States. Covered forklifts include Toyota IC forklifts with 4Y, 1FS, 1ZS, or 1KD engines, subject to the detailed eligibility criteria in the official settlement documents.

What is the benefit?

Eligible claimants may submit a claim for cash compensation from the settlement fund. Public settlement materials state that estimated payments may be approximately $1,000 to $2,500 per qualifying forklift, depending on the claim category, approved claims, deductions, and the Court-approved allocation process. Settlement Class Members may also be eligible for a free Service Plan visit and a New Parts Warranty benefit under the settlement terms.
