The Court has not decided who is right. Direct Purchaser settlement documents currently disclose proposed settlement funds with OPIS, Westlake, and Atkore totaling approximately $142.5 million before court-approved fees, expenses, administrative costs, service awards, allocation adjustments, and deductions.
Who will be eligible?
Your organization may be eligible if it purchased PVC Pipe and PVC Fittings in the United States and its territories directly from one or more Converter Defendants, including their parents, predecessors, subsidiaries, and affiliates, during the applicable settlement period. This outreach is for Direct Purchasers only. Purchases through distributors, resellers, retailers, contractors, home improvement stores, and other non-converter sellers should not be treated as Direct Purchaser targets unless the organization also bought directly from a Converter Defendant.
What is the benefit?
Eligible Direct Purchaser class members may receive compensation from approved settlement funds after final approvals, claim procedures, and allocation procedures are established. Recovery will depend on eligible purchase records, the final court-approved allocation plan, total approved claims, deductions, and any future settlements or recoveries.
